General terms and conditions of sale

1.1 All orders placed on the Visilab sales website are governed by these General Terms and Conditions of Sale, which form an integral part of the contract and apply to the exclusion of all other conditions. By placing an order, you acknowledge that you have read, understood and accepted, without any reservation, these General Terms and Conditions of Sale.

1.2 By using this website, you also agree to be bound by the legal notices on the Visilab website, including the provisions on the protection of personal data. Visilab encourages you to read these provisions carefully before using the services provided on this site.

1.3 You are informed that your personal data will be processed by Visilab SA in accordance with Swiss data protection legislation. For certain data processing operations, Visilab may commission third parties who are bound by the same legislation.

1.4 Visilab reserves the right to amend these General Terms and Conditions of Sale at any time by publishing a new version on the Visilab sales website. Each order placed after Visilab has published the new version of its General Terms and Conditions of Sale constitutes acceptance of the latter.

2.1 By registering on the Visilab sales website, you confirm that the data you provide is accurate and complete.

2.2 Please inform Visilab of any changes to the personal data you have provided, which we ask you to check each time you use the website. 

3.1 You must set a password when you register on the Visilab sales website. This password is strictly confidential and must not be disclosed to third parties.

3.2 You are fully responsible for the use of your password and for all orders placed with the use of your password, including those placed without your knowledge.

3.3 If you are aware or suspect that a third party knows or is using your password, you must inform Visilab’s customer service without delay.

4.1 By placing an order on this website, you agree to purchase the products you have selected in accordance with these General Terms and Conditions of Sale and to pay the corresponding price.

4.2 Orders you place with Visilab on this website are subject to maximum quantity limits. The maximum order quantity per product is 10 units.

4.3 Visilab offers its products for sale on this website while stocks last.

4.4 Only persons of legal age may place orders on this website.

4.5 Contact lenses: by confirming your order, you guarantee the following:

4.5.1 You will only order contact lenses that have been previously prescribed by a contact lens specialist (qualified optician or ophthalmologist) and are well tolerated by your eyes. Your Visilab optician advises you to undergo annual check-ups to ensure optimal wearing safety.

4.5.2 You will have your contact lenses checked regularly by a specialist and no contraindications to wearing contact lenses have been ascertained.

4.5.3 You will comply with the prescribed duration of wear.

4.5.4 You are familiar with and fully comply with the instructions you have been given by your contact lens specialist for the care and handling of contact lenses. If in doubt, please contact your contact lens specialist.

4.5.5 You will stop wearing contact lenses immediately if any complications arise, and will immediately undergo an examination by a qualified optician or ophthalmologist.

4.5.6 You release Visilab from any liability for any damage caused by wearing contact lenses or by a lack of tolerance to the products and, in particular, for any damage to health. You also release Visilab from any liability if products are used in a manner that does not comply with the manufacturer’s instructions or with the prescriptions of your qualified optician or ophthalmologist.

4.5.7 You will not sue Visilab for complications, disorders, any other problems or for product liability, but will contact the manufacturer directly and exclusively. It is your responsibility to find out the details of the warranty directly from the manufacturer. 

5.1 If you wish, you can opt for the contact lens subscription service. This service allows you to automatically receive products you have previously selected (contact lenses and/or care products) and according to the frequency you have defined.

5.2 In the event of insolvency, we will suspend delivery until we receive your payment.

5.3 You can change the date of the next shipment or cancel this service at any time.

5.4 You can take advantage of special offers that are specifically compatible with this option. However, the contact lens subscription service does not automatically entitle you to benefit from other current special offers and promotions. In order to benefit from such offers, we advise you to place a separate order.

5.5 If a maintenance product included in your subscription is out of stock, Visilab will send you a message to notify you. If you do not react or respond to this message within 10 days, Visilab will replace the unavailable product with a product with the same characteristics.  

6.1 An order placed by you on this website will be taken into account when it is confirmed by an e-mail from Visilab.

6.2 Visilab reserves the right to refuse an order without giving a reason.

6.3 The data recorded by Visilab constitutes irrefutable proof of the order or transaction. The data recorded by the payment system constitutes irrefutable proof of the financial transaction.

7.1 The prices payable for the goods you order are those shown on this website on the date of the order, inclusive of VAT but exclusive of delivery charges.

7.2 Prices are quoted in Swiss francs (CHF) and include VAT.

7.3 Prices for time-limited offers are only valid during the period indicated.

7.4 Visilab reserves the right to change its prices and delivery charges at any time, but increases will not apply to current orders.

8.1 All orders confirmed by Visilab will be delivered to the address indicated in the order.

8.2 Delivery costs are charged at the rates indicated on the Visilab sales website on the date of the order. Their calculation depends in particular on the order value and the chosen delivery method.

8.3 Visilab will make every effort to ensure delivery within ten working days of receipt of an individual order. This 10-day period is given as an indication and is not contractual.

8.4 Deliveries may only be made within Switzerland.

9.1 Payment of the price of the goods must be made by credit or debit card, PayPal, Twint or gift card, or alternatively by payment on account.

9.2 Your credit card details are encrypted for security reasons and are not stored by Visilab.

9.3 The delivered goods remain the property of VISILAB until full payment has been made.

9.4 MF Group / POWERPAY offers “payment on account” in its capacity as an independent payment provider. This simply allows you to pay for your online purchase by invoice. If you do not pay by the specified date, you will receive a retroactive invoice the following month with an overview of the order. Upon conclusion of the purchase contract, POWERPAY will take over the invoice receivable and handle the payment processing. If you make a purchase on account, you accept the General Terms and Conditions of POWERPAY in addition to our own General Terms and Conditions. 

You will receive your monthly invoice by post during the month following your purchase. If you wish to pay in instalments, the minimum monthly payment is 10% of the invoice amount. This allows you to decide individually and flexibly in how many instalments you wish to pay for your purchase. Please note that the administration fee of CHF 2.90 will be borne by Visilab for the first invoice. Under this agreement, MF Finance AG / PowerPay grants you a consumer credit in accordance with Art. 12 of the Federal Consumer Credit Act (LCC), provided that you make use of the flexible payment option and that no grounds for exclusion in accordance with Art. 7 para. 1 LCC exist. 

10.1 It is your responsibility to check the quantity and condition of the goods on delivery and to notify Visilab within 7 working days of any damage or discrepancy between the product sent and the product ordered.

11.1 It is possible to request the exchange of a product or a refund against return of the goods (except for glasses with optical lenses, see conditions in paragraph 11.8).

11.2 For sunglasses, the goods must be returned in their original, unused condition and in their original packaging (including accessories). The deadline for returns is 30 days from the date of receipt of the goods.

11.3 For contact lenses, the goods may be returned exclusively in their original packaging, provided that this has not been opened or damaged. The deadline for returns is 30 days from the date of receipt of the goods.

11.4 Products purchased on sale and from the Outlet selection cannot be returned or exchanged. The same applies to gift cards.

11.5 If goods are returned in the prescribed manner, Visilab will make every effort to refund the price of the returned goods within 15 days of their receipt.

11.6 If you return goods, the delivery costs set out in the order remain payable by you and the risks associated with the return remain your responsibility.

11.7 If you return goods directly to our central warehouse, you will be responsible for the postage costs of returning the goods. To avoid these costs, you can return the goods to a Visilab store yourself.

11.8 The deadline for returns is 30 days from the date of receipt of the goods. The deadline for exchanging goods is 30 days from the date of receipt of the goods, and even 90 days if you have subscribed to a Service Pack. 

12.1 Optical glasses, optical lenses, sunglasses and contact lenses are guaranteed against manufacturing defects for a period of 2 years from the date of delivery in accordance with the conditions indicated for each product. Defective goods may be returned or exchanged. A defect report must be completed in a Visilab store. This guarantee excludes and replaces the statutory warranty provisions for defects. The guarantee for defects is neither renewable nor extendable in the event of an exchange of goods.

13.1 Breakage insurance for 2 years (1 year for juniors)

This covers the frame (breakage and torsion) and lenses (breakage, cracks and scratches that impair vision) for a period of 2 years for adults, or 1 year for juniors up to the age of 18, from the date of delivery of your glasses by your Visilab store. It allows damaged components to be replaced according to the following conditions:

• During the 1st year: free exchange in the event of breakage or damage
• During the 2nd year: a contribution of 30% of the price of the new item must be paid by the customer

If the frame is no longer available, Visilab undertakes to replace it with another model of an equivalent price, according to the same conditions.

13.2 Single-vision lens Service Pack
The Service Pack includes the following services: 

• 2-year breakage insurance as described in paragraph 13.1;
• Correction change guarantee: if your eyesight changes within 6 months of the date of delivery of your glasses, Visilab undertakes to exchange your lenses free of charge with identical lenses (same range and same coatings) to take into account your new correction. Valid for a single change of correction of a minimum of 0.5 dioptres after verification by a qualified Visilab optician for adults or an ophthalmologist for juniors up to the age of 18 (please provide the medical prescription);
• Extended satisfaction guarantee for 90 days instead of 30: choose your glasses with confidence, you have 90 days to change your mind. The extended satisfaction guarantee offered by Visilab allows you to exchange your frame and optical lenses with complete peace of mind, within 90 days of your purchase, whether for aesthetic, comfort or adaptation reasons. Visilab will reimburse the difference if the new frame or lenses cost less. Otherwise, the difference is at your expense. Visilab accepts one exchange only, within 90 days of your purchase;
• Loss or theft insurance for 2 years (1 year for juniors): this insurance covers the loss or theft of your glasses for a period of 2 years for adults, or 1 year for juniors up to the age of 18, from the date of delivery of your glasses. Visilab undertakes to replace your glasses with an identical pair against payment of a deductible of 30% of the sales price of the new pair before discounts. The maximum insured value of the initial pair is capped at CHF 3,000. This insurance is valid for one case of loss or theft only;
• Replacement glasses or contact lenses adapted to your eyesight in the event of breakage, loss or theft: in the event of breakage, loss or theft of your glasses within 2 years of the date of purchase (within 1 year for juniors up to the age of 18), Visilab undertakes to provide you with a replacement solution during their repair or until delivery of your new glasses.

Depending on your usage and the duration of the repair, you can choose between:

• A pair of replacement glasses with a frame from the V-Budget range and basic clear, uncoated lenses adapted to your correction.
• Daily or monthly spherical contact lenses adapted to your correction (from the age of 18).

All of these services included in the Service Pack are valid in all stores within the Visilab network in Switzerland. The Service Pack can neither be renewed nor extended.

14.1 Visilab accepts no liability for minor product deviations or omissions from the photos or texts that feature on this website.

14.2 In no case shall the non-delivery of products give rise to a refund greater than the purchase price of the products. No claim for damages may exceed this amount. IN NO EVENT SHALL VISILAB BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES ARISING IN CONNECTION WITH ITS PRODUCTS, THEIR USE, OR THEIR SALE ON THIS SITE.

15.1 Visilab will do its utmost to fulfil its obligations but cannot be held liable for delays or non-delivery due to circumstances beyond its control, such as strikes, wars, natural disasters or other events that prevent the production, transport or delivery of products.

15.2 In the event of a delay, Visilab will fulfil its obligations as soon as possible and reserves the right to distribute the remaining stocks of products among its customers in an equitable manner.

16.1 These General Terms and Conditions of Sale are governed by Swiss law.

16.2 Any dispute arising from the interpretation, application or execution of these General Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the Canton in which the Visilab Group has its registered office, subject to mandatory legal provisions and the right of appeal to the Federal Court.

17.1 LIBERTY Junior Pack for CHF 158:

 *Unofficial Kids frame and V-One Essential anti-reflective lenses, reimbursed in full. For the purchase of a frame from the Unofficial Kids collection and two V-One Essential 1.5 lenses with 2G anti-reflective coating. Technical services and breakage insurance (1 year) free of charge. This means a cost of CHF 0 subject to coverage by basic health insurance (after deduction of a personal contribution of 10% and provided that the deductible is reached), according to the terms and conditions of insurance.
